Regulation on the Implementation of the Turkish Citizenship Law

Within the scope of subparagraph (b) of the second paragraph of Article 20 of the Regulation on the Implementation of the Turkish Citizenship Law: Foreigners who “Purchased a real estate amounting to at least $400,000 or its equivalent in foreign currency or Turkish Lira with the condition that an annotation not to be sold for three years has been put in the land registry records, or on which a condominium or a construction servitude has been established, and who have been determined by the Ministry of Environment and Urbanization that the notarized contract promising the sale of the real estate for which at least $400,000 or its equivalent in foreign currency or in Turkish Lira has been deposited in advance has been annotated to the land registry with the commitment that it will not be transferred or abandoned for three years” may acquire Turkish citizenship with the President's decision. Five amendments were made to the Regulation, which entered into force on 12.01.2017, 19.09.2018, 07.12.2018, 06.01.2022 and 13.06.2022.

With the amendment to the Regulation, the practice of issuing a “Certificate of Conformity” by giving a commitment for real estate(s) acquired for a minimum value of $250,000 has been terminated (the method of completion of the final transaction applications worth $250,000 is instructed separately).

With the amendment to the Regulation, the practice of issuing a “Real Estate Investment Determination Certificate” by giving a commitment for real estate(s) acquired for a minimum value of $250,000 has been terminated (the method of completion of the final transaction applications worth $250,000 is instructed separately).

  • Accordingly;
  • The value of the real estate(s) purchased between 12.01.2017 and 18.09.2018 must be $1,000,000,
  • The value of the real estate(s) purchased/to be purchased after 19.09.2018 must be $400,000,
  • The value of the real estate(s) for which a preliminary sales contract has been/will be issued after 07.12.2018 must be $400,000,
  • With the amendment made on 06.01.2022, the phrase “Turkish Lira equivalent” was removed from the regulation and the foreign currency amount of the real estate must be sold to a bank to be sold to the Central Bank
  • With the amendment dated 12.12.2023, agricultural real estates and non-built real estates with land qualifications were no longer subject to the acquisition of citizenship. The condition of being built will be sought for real estates with land qualifications.

Guidelines

You can download our guideline prepared in order to regulate the procedures and principles to be applied in the transactions to be carried out by the land registry offices regarding the acquisition of Turkish citizenship through real estate acquisition and to inform foreigners from the link on the left. The provisions of the guidelines entered into force on 09/12/2024.

Transaction Stages

Roadmap and procedures for the acquisition of real estate for the purpose of acquiring citizenship.

An agreement is made for the real estate to be purchased. The value of the real estate must be at least $400,000.

A “Real Estate Appraisal Report” based on the Price Determination Certificate (TTB) regarding the confirmation of the investment amount for the real estate is issued via Webtapu WEBTAPU

An application is made to the land registry office with the necessary documents, including the foreign currency purchase certificate via REM.

It is checked by the land registry office whether the values declared in the foreign currency purchase certificate, official deed or preliminary contract for sale, and receipt meet the criteria sought in the regulation and that these values are confirmed with TTB.

If the necessary conditions are met, the title deed fee and revolving fund fee to be paid for the transaction are notified to the relevant person via SMS.

After the fees are paid, an appointment time is notified via SMS for the signing of the contract.

After the signatures are put and the contract is completed, an annotation that the real estate will not be sold for three years is placed in the registry of the real estate and the title deed of the real estate is delivered to the relevant person.

Following the completion of the transaction, the transaction documents are notified by the land registry office to the General Directorate/Regional Directorate to issue a “Certificate of Conformity” for the citizenship application through the system.

Necessary checks are made and “Certificate of Conformity” is issued.

The “Certificate of Conformity” is sent via e-mail to the General Directorate of Population and Citizenship Affairs and the General Directorate of Migration Management for action, and to the relevant person for information.
